Do You Need a Building Permit? A Plain-English Guide for GTA Renovations

Permits are the part of a renovation homeowners most want to avoid and most regret avoiding. Here is how to think about it.

Work that normally needs a permit

· Structural changes, including removing or altering a load-bearing wall

· Additions, dormers, and enclosing a porch or garage

· Finishing a basement where new rooms, plumbing or fire separations are created

· Adding or relocating plumbing fixtures

· Decks above a certain height and most detached structures above a certain area

· New or enlarged window and door openings in a foundation or exterior wall

· Second units and accessory dwelling units

Work that usually does not

· Painting, flooring, and cabinetry replacement in the same footprint

· Replacing a fixture where it already sits

· Re-shingling within existing structure

· Non-structural interior finishes

Thresholds vary by municipality, so confirm with your city before assuming. In our region that means the City of Brampton, City of Mississauga or City of Toronto building department, depending on where you live.

What the process actually looks like

· Drawings are prepared showing the existing and proposed condition

· Application and fees are submitted, sometimes with zoning review first

· Permit is issued, and the placard goes up on site

· Inspections happen at defined stages: footings, framing, insulation and vapour barrier, plumbing, and final

· Electrical is a separate ESA permit and inspection

Timelines depend on the municipality and how complete the submission is. Incomplete drawings are the most common cause of delay, which is why we prepare them before applying rather than during.

What happens when work is done without a permit

· A stop work order and an order to comply, which can require opening up finished work

· Difficulty at resale, when a lawyer or buyer asks for permit closure

· Insurance complications after a claim tied to unpermitted work

· Fees that are higher than the original permit would have been

Who pulls the permit

On our projects, we handle the drawings, application and inspection scheduling as part of the scope, and the permit stays open until final sign-off. Ask any contractor you are considering to state in writing who is responsible for the permit and who books the inspections.
